Israeli Supreme Court Rejects PLO's Effort to Remove NIS 64 Million Lien PDF Print E-mail

Image November 11, 2008: Israeli Supreme Court handed down a ruling rejecting the Palestinian Authority's (PA) motion to cancel a preemptive lien placed on Palestinian funds in the amount of  NIS 64 million. The lien, placed on Palestinian tax revenues held by the Israeli Treasury, was issued on October 2002 to secure the eventual enforcement of a lawsuit brought by the family of the Israeli soldier who was brutally murdered in a Ramallah police station in the beginning of the current intifada.

This was the infamous attack, captured by reporters on video tape of the lynching of two innocent reserve soldiers who had mistakenly driven into the PA and were arrested by Palestinian police.

In 2004, the PA filed their original motion for reconsideration of the lien which was eventually rejected. Then, two months ago, the PA appealed to the Supreme Court asking it tounfreeze their funds. The Palestinians argued that their money need not be attached until the end of the proceeding when a judgment would be rendered by the lower court. They, however, failed to provide any compelling arguments as to why the lien should be canceled. The Supreme Court ruled that there was no change in circumstances which might justify the removal of the lien and, therefore, there was no basis for reconsideration of the matter. Thus, the Court denied the Palestinians' appeal.
